ONLINE STORE REGULATIONS
I. Definitions
The terms used in the Regulations mean:
- Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, which places an Order within the Store;
- Consumer – in accordance with Article 22[1] of the Civil Code, means a natural person concluding a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
- A natural person conducting business activity - in accordance with the Civil Code and the Consumer Protection Act, means a person conducting business activity concluding a distance sales agreement with a seller that is not of a professional nature for them, and therefore does not concern the industry in which they specialize.
- Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93);
- Regulations – these Regulations defining the general terms and conditions of sale and the principles of providing services electronically within the Stroimy.pl online store;
- Online store (Store) – online service available at www.stoimy.pl through which the Customer may, in particular, place Orders;
- Goods – products presented in the Online Store;
- Sales Agreement – a sales agreement for Goods within the meaning of the Civil Code, concluded between Stroimy.pl and the Customer, concluded using the online service of the Store;
- Consumer Rights Act – Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827);
- Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204);
- Order – declaration of will of the Customer, aimed directly at concluding the Sales Agreement, specifying in particular the type and number of
II. General Provisions
- These Regulations define the rules of using the online store available at stroimy.pl
- These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.
- The Stroimy.pl online store, operating at www.stroimy.pl, is run by Bartosz Krala Stroimy.pl, ul. Starowiejska 5/13 61-664, Poznań, NIP: 7773199444, REGON: 383053873.
- These Regulations specify in particular:
- rules for registering and using an account in the online store;
- terms and conditions for placing Orders electronically within the online store;
- principles of concluding Sales Agreements using the services provided within the Online Store.
- Using the online store is possible provided that the IT system used by the Customer meets the following minimum technical requirements: A computer with internet access.
- In order to use the online store, the Customer should obtain access to a computer station or terminal device with Internet access on their own,
- In accordance with applicable law, Stroimy.pl reserves the right to limit the provision of services via the Online Store to persons who are over the age of 18. In such a case, potential Customers will be notified of the above.
- Customers can access these Regulations at any time via the link on the home page of the stroimy.pl website. and download it and print it out.
III. Rules for using the Online Store
- Registration in the Online Store is optional. The Customer may place an order without registering in the Store, after reading these Regulations and its Registration is done by filling in and accepting the registration form, available on one of the Store's pages.
The condition for registration is to agree to the content of the Regulations and to provide personal data marked as mandatory.
Stroimy.pl may deprive the Customer of the right to use the Online Store, and may also limit his access to some or all of the resources of the Online Store, with immediate effect, in the event of a breach of the Regulations by the Customer, and in particular when the Customer:
- provided false, inaccurate or outdated data, misleading data or data violating the rights of third parties, during registration in the online store,
- has violated the personal rights of third parties through the online store, in particular the personal rights of other customers of the online store,
- engages in other behaviors that GoDan Party considers to be inconsistent with applicable legal provisions or general principles of using the Internet or detrimental to the good name of GoDan
- In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data sent via the Internet.
- The customer is obliged in particular to:
- use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.
- not providing or transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
- using the Online Store in a way that does not disrupt its functioning, in particular through the use of specific software or devices,
- not to take actions such as: sending or placing unsolicited commercial information (spam) within the Online Store,
- using the Online Store in a way that is not burdensome for other customers and for Stroimy.pl,
- use any content posted on the Online Store only for your own personal use,
IV. Procedure for concluding the Sales Agreement
- In order to conclude a Sales Agreement via the Online Store, go to the website stroimy.pl and select the Goods by performing subsequent technical steps based on the messages displayed to the Customer and the information available on the website.
- The Customer selects the Goods to be ordered by adding them to the shopping cart.
- During the Order placement process – until the button confirming the Order placement is pressed – the Customer has the option to modify the entered data and the selected Product. To do this, the Customer should follow the messages displayed to the Customer and the information available on the website.
- After the Customer using the Online Store has provided all necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include, among other things, a description of the selected goods or services, the total price and all other costs.
- In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the button confirming placement of the Order.
- Information about the Goods provided on the Store's websites constitutes an offer within the meaning of Article 66 of the Civil Code. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with Stroimy.pl, in accordance with the content of the Agreement is treated as concluded at the moment of receipt of the Customer's Order in the IT system of the Online Store, provided that the Order complies with the Regulations. After concluding the agreement, the Customer receives an e-mail containing confirmation of all essential elements of the Order.

The order data and the General Terms and Conditions (sales regulations) are saved, secured and made available via email. You can view previous orders within your account after logging in.
V. Delivery
- Delivery of the Goods is limited to the territory of the Republic of Poland and takes place to the address indicated by the Customer when placing the Order.

Additionally, shipping costs will be indicated at the time of placing the Order.
- The delivery time is 2 days and is counted from the day the Customer sends the Order.
- Damage to the Goods incurred during
In the case of a consumer purchase at a distance, our Store always bears the risk of accidental damage or loss of goods in transport, similarly in the case of individuals conducting business activities who are not consumers within the meaning of the Consumer Rights Act and the Civil Code. If the goods are delivered with obvious damage caused during transport, we kindly ask you to report such a defect to the carrier as soon as possible and contact us. Delay in reporting such a complaint or establishing contact has no consequences for your statutory claims and their satisfaction, in particular for your rights under the statutory warranty for defects (item VIII of the Regulations). Faster reporting of noticed damage caused during transport helps us to pursue our own claims against the carrier or transport insurer.
In the case of a Customer who is not also a Consumer and natural persons conducting business activities who are not consumers within the meaning of the Consumer Rights Act and the Civil Code: the risk of accidental damage to or loss of the Goods is transferred from the Online Store to the buyer at the moment of entrusting the Goods to a carrier engaged in the transport of goods of a given type, or to a person or courier company designated by the buyer.

- The prices of the Goods are given in Polish zloty and include all components, including VAT, customs duties and all other components.
- The customer has the option to pay the amount before the goods are shipped (traditional transfer or PayU payment) in the case of prepayment or upon delivery of the shipment by the courier (cash) in the case of a shipment

VII. Right of withdrawal
A Customer who is also a Consumer and individuals conducting business activity who are not consumers within the meaning of the Consumer Rights Act and the Civil Code, in accordance with the Act, has the right to withdraw from the contract, without giving a reason, within 14 days from the day on which he or she came into possession of the item or on which a third party other than the carrier and indicated by the party to the contract came into possession of the item. VIII. Complaints about Goods
Applies to a Client who is a Consumer and natural persons conducting business activity who are not consumers within the meaning of the Consumer Rights Act and the Civil Code.:
We are obliged to deliver goods free from defects. The statutory law of liability for defects of the sold item (warranty for defects) applies to the extent specified in art. 556 and art. 556[1]-556[3] and subsequent articles of the Civil Code.

In the event of exercising warranty rights – if we consider it necessary to consider the complaint, you are obliged to deliver the defective goods at our expense to the postal address indicated above. If, due to the type of goods or the way they are installed, the delivery of the goods would be excessively difficult, you are obliged to make them available to us at the place where they are located. We undertake to respond to the complaint immediately, no later than within 14 days from the date of its submission.
We are liable under the warranty to consumers and individuals conducting business activities who are not consumers within the meaning of the Consumer Rights Act and the Civil Code. if a physical defect is found before the expiry of two years from the date of issue of the goods to you. In the event that the subject of sale is a used movable item, liability under the warranty is one year from the date of issue.
When submitting a complaint, it is recommended to (1) provide information regarding the subject of the complaint, in particular the type and date of occurrence of the defect; (2) specify the request regarding the method of removing the defect (replacement of the product with a new one, repair of the product, reduction of the price, withdrawal from the contract - if the defect is significant); and (3) provide the contact details of the person submitting the complaint - this will facilitate and speed up the consideration of the complaint by the Store.
The recommendations set out in the preceding sentence take the form of non-binding guidelines only and in no way affect the effectiveness of complaints submitted without providing the recommended information.
Applies to a Client who is not a Consumer but is an Entrepreneur:
In the case of a Sales Agreement concluded with a Customer who is not also a Consumer, pursuant to Article 558 § 1 of the Civil Code, the liability of the Online Store under the warranty for defects in the Goods is excluded. This exclusion is ineffective in the event of our fraudulent concealment of the defect. The above does not apply to individuals conducting business activities concluding a distance sales agreement with the seller, which is not of a professional nature for them, and therefore does not concern the industry in which they specialize
IX. Additional guarantees for the sale of Goods in the Store
Stroimy.pl is the manufacturer of some of the Goods available in the Store. Stroimy.pl is not liable under the warranty for the sold Goods. In relation to Goods whose manufacturer is not Stroimy.pl , the manufacturer may bear independent liability under the warranty for the sold Goods under the terms and for the period indicated in the warranty card issued by the manufacturer. If the manufacturer's warranty document provides for such a possibility, the Customer may submit their claims under the warranty directly to an authorized service center, the address of which is provided in the warranty card.
All Goods available in the Store are subject to independent liability Stroimy.pl based on statutory provisions on warranty for defects. The warranty does not exclude, limit or suspend the Customer's rights resulting from the provisions on warranty for defects in the sold item.
X. Complaints regarding the provision of services by electronic means
- Stroimy.pl takes steps to ensure the proper operation of the Online Store, to the extent that results from the current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
- The Client may notify us of any irregularities or interruptions in the functioning of the Online Store service. Please report irregularities related to the functioning of the Store by e-mail to the following address: sklepstroimypl@gmail.com
- In a complaint regarding irregularities related to the operation of the Online Store service, please indicate the type and date of the irregularity.
- We undertake to respond to the complaint immediately, no later than within 14 days from the date of its submission.
XI. Extrajudicial methods of handling complaints and pursuing claims
- We inform you that there are possibilities of using out-of-court methods of handling complaints and pursuing claims. Using them is voluntary and can only take place if both parties to the dispute agree to it.
- The consumer may file a motion to initiate proceedings for the out-of-court resolution of consumer disputes concerning the concluded Sales Agreement with the Trade Inspection, in accordance with Article 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws 2001 No. 4, item 25, ). This point also extends to natural persons conducting business activity, concluding a distance sales agreement with the seller, which is not of a professional nature for them, and therefore does not concern the industry in which they specialize
- The consumer may also file a motion to have a dispute concerning the concluded Sales Agreement resolved by a permanent arbitration court operating at the relevant provincial inspectorate of the Trade Inspection, in accordance with art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws 2001 No. 4, item 25, as amended). This point also extends to natural persons conducting business activity, concluding a distance sales agreement with the seller, which is not of a professional nature for them, and therefore does not concern the industry in which they specialize.

XII. Final Provisions
- The court with jurisdiction to resolve disputes with Consumers and individuals conducting business activities who conclude a distance sales agreement with the seller that is not of a professional nature for them, and therefore does not concern the industry in which they specialise, is the court with local jurisdiction over the location of the seller.
- Any disputes arising between Stroimy.pl and a Customer who is not a Consumer shall be submitted to the court with jurisdiction over our registered office.
- In matters not regulated in these Regulations, the provisions of the applicable law shall apply, in particular the provisions of the Act of 23 April 1964 - the Civil Code (consolidated text Journal of Laws of 2014, item 121, as amended) and the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827). In the event of any conflict between these Regulations and the rights of Customers and provisions resulting from generally applicable provisions, the generally applicable provisions of law shall apply.
